Medical excuse

August 1st, 2007 · No Comments

Our rules of court now do not contain clear provisions on the use of medical reason to be excused from appearances or compliance with order. It is therefor subject to abuse. Any physical discomfort, real or imagined, duly backed up by a medical certificate becomes a source of delay. And in this country, getting certified is not a difficult thing to do. In fact, way back in school, we do this already.

Note the big cases when the accused can just be excused on medical grounds.
